Terms & Conditions of Hire

These Terms & Conditions apply to the hire of equipment from SB Lite Limited (“SB Lite & DIY Uplighting”).
Please read these Terms carefully before completing a booking. By completing a booking and accepting these Terms, the Hirer agrees to be bound by them.

1. Definitions
1.1 “SB Lite” means SB Lite Limited. DIY Uplighting is part of SB Lite Ltd.
1.2 “Contract” means the contract between SB Lite and the Hirer for the hire of Equipment.
1.3 “Equipment” means all equipment, uplighters, accessories, cables, remotes, cases and other items supplied by SB Lite as part of the hire.
1.4 “Hire Charge” means the amount payable for hiring the Equipment.
1.5 “Hire Confirmation” means the booking confirmation supplied by SB Lite setting out the details of the hire.
1.6 “Hirer” means the person, company, partnership or organisation entering into the Contract with SB Lite.
1.7 “Consumer Hirer” means an individual entering into the Contract wholly or mainly for purposes outside their trade, business, craft or profession.
1.8 “Business Hirer” means a person, company, partnership or organisation entering into the Contract wholly or mainly for purposes relating to their trade, business, craft or profession.
1.9 “Replacement Cost List” means the Equipment and Replacement Cost List displayed or made available to the Hirer as part of the booking.
2. Eligibility and Identity Verification
2.1 The person making the booking must be at least 18 years old and legally capable of entering into the Contract.
2.2 SB Lite requires identity verification as a condition of hire. The Hirer must provide one form of identification through SB Lite’s online verification process or another method approved by SB Lite.
2.3 SB Lite may request additional information or documentation where reasonably necessary to verify the Hirer’s identity, address, payment details or information relating to the booking.
2.4 SB Lite is not required to dispatch or release Equipment until the required identity verification has been satisfactorily completed.
2.5 Where the Hirer fails or refuses to provide the required identification, or SB Lite reasonably considers that the information supplied cannot be satisfactorily verified, SB Lite may suspend or cancel the booking.
Where cancellation results from the Hirer’s failure to complete the required verification process, the booking may be treated as a cancellation or default by the Hirer and the Hire Charges will remain non-refundable, subject to applicable law.
3. Period of Hire
3.1 The hire period begins when the Equipment is delivered to the Hirer by DPD or another courier appointed by SB Lite, or when the Equipment is collected directly by the Hirer.
3.2 The hire period ends when the Equipment is:
- accepted by DPD or another return service authorised by SB Lite for return to SB Lite;
- collected by a courier arranged by SB Lite; or
- returned directly to and accepted by SB Lite.
3.3 The required return date will be stated on the Hire Confirmation or return instructions supplied by SB Lite.
3.4 Unless a collection service has been purchased or otherwise agreed, the Hirer is responsible for returning the Equipment to an authorised DPD drop-off location by the required return date.
3.5 Where the Hirer purchases a collection service, the Hirer must ensure that the Equipment is correctly packed and available for collection at the agreed address and on the agreed date.
3.6 Equipment returned late may be subject to a late return charge of up to twice the equivalent daily Hire Charge for each additional day or part thereof that the Equipment remains unreturned.
3.7 Where a late return directly prevents SB Lite from fulfilling another confirmed booking, the Hirer may also be responsible for reasonable direct losses incurred by SB Lite as a result, subject to applicable law.
4. Ownership of Equipment
4.1 All Equipment remains the absolute property of SB Lite at all times.
4.2 The Hirer obtains no ownership rights in the Equipment.
4.3 The Hirer must not sell, assign, sub-hire, transfer, pledge or otherwise part with possession or control of the Equipment without SB Lite’s prior written consent.
4.4 SB Lite reserves the right to install location or GPS tracking devices in Equipment where appropriate and to use such devices for legitimate purposes including locating, protecting and recovering its Equipment, subject to applicable data protection law.
5. Location of Equipment
5.1 Equipment must remain within mainland United Kingdom during the hire unless:
- the delivery address accepted by SB Lite as part of the booking is outside mainland United Kingdom; or
- SB Lite has expressly agreed otherwise in writing.
5.2 The Hirer must not subsequently take Equipment outside the territory or destination agreed as part of the booking without SB Lite’s prior written permission.
6. Receipt and Checking of Equipment
6.1 The Hirer must inspect and, where reasonably practicable, test the Equipment as soon as possible following delivery or collection.
6.2 Any missing item, visible damage or apparent fault should be reported to SB Lite as soon as reasonably possible after it is discovered.
6.3 The Hirer should provide reasonable information requested by SB Lite to help identify a reported problem, including photographs or video where appropriate.
6.4 The Hirer must provide SB Lite with a reasonable opportunity to troubleshoot or resolve a reported problem.
6.5 The Hirer must not dismantle, modify or attempt to repair Equipment without SB Lite’s prior permission.
7. Equipment Faults
7.1 Where an individual item of Equipment is confirmed to be faulty and SB Lite is unable to provide a reasonable remedy, any applicable refund will normally be limited to the proportion of the Hire Charge attributable to that item.
For example, where 10 identical uplighters are hired for a total Hire Charge of £99 and one is confirmed to be faulty, the applicable refund for that uplighter would be £9.90.
7.2 A fault affecting one item does not automatically entitle the Hirer to a refund for the entire booking where the remaining Equipment is available and usable.
7.3 SB Lite will not normally provide a refund for a fault which was not reported during the hire period where SB Lite was not given a reasonable opportunity to investigate or remedy the problem.
7.4 Nothing in this section affects statutory rights or remedies which cannot lawfully be excluded or restricted.
8. Equipment Substitution
8.1 Where reasonably necessary, SB Lite may substitute Equipment with another item providing substantially equivalent or better functionality.
8.2 A reasonable substitution with equivalent or better Equipment will not constitute a failure by SB Lite to fulfil the booking.
8.3 Where SB Lite is unable to supply part of a booking and cannot provide a reasonable equivalent, SB Lite may provide a proportionate refund for the affected Equipment.
8.4 The inability to supply an individual item does not automatically entitle the Hirer to cancel or receive a refund for unaffected Equipment which has been supplied and remains usable.
9. Use and Safety
9.1 The Hirer is responsible for using the Equipment safely and in accordance with instructions supplied by SB Lite.
9.2 Equipment should only be operated by a competent person.
9.3 Where appropriate, the Hirer is responsible for carrying out any risk assessment required for the intended use of the Equipment.
9.4 Equipment must not be deliberately misused, modified or operated contrary to instructions supplied by SB Lite.
9.5 The Hirer is responsible for ensuring that Equipment is positioned securely and does not create an unreasonable trip, electrical or other safety hazard.
10. Charging and Battery Equipment
10.1 Uplighters supplied by SB Lite are provided with the required charge for their intended hire period and must not be charged by the Hirer unless expressly instructed otherwise by SB Lite.
10.2 The Hirer must not connect uplighters to an unauthorised charger, power supply or charging equipment.
10.3 Attempting to charge, modify or interfere with a battery, charging system or internal electronics may result in the Hirer being responsible for resulting damage or loss.
10.4 Accessories which are intended to be charged by the Hirer may only be charged in accordance with instructions supplied by SB Lite.
11. Outdoor Use
11.1 Uplighters which SB Lite confirms are suitable for outdoor use may be used outdoors in light rain, provided reasonable precautions are taken.
11.2 Equipment must not be submerged in water or positioned where water is likely to pool or accumulate around it.
11.3 Equipment must not be used in flooding, standing water, heavy or extreme weather conditions, or where continued use would be unsafe.
11.4 The Hirer is responsible for monitoring weather and site conditions and moving Equipment to a suitable protected location where conditions become unsuitable.
11.5 The Hirer may be responsible for damage resulting from inappropriate outdoor use or failure to take reasonable precautions.
12. Venues, Installation and Setup
12.1 Unless installation or setup is expressly included on the Hire Confirmation, Equipment is supplied on a self-installation or DIY basis.
12.2 The Hirer is responsible for positioning, setting up and operating the Equipment in accordance with the supplied instructions.
12.3 The Hirer is responsible for checking that their venue, property or event location permits use of the Equipment.
12.4 SB Lite will not normally provide a refund where Equipment cannot be used because of restrictions imposed by a venue, property owner, event organiser or other third party, provided that the Equipment supplied was as described and suitable for its intended use.
12.5 The Hirer is responsible for obtaining any permission, approval or consent required for use of the Equipment.
13. Loss of or Damage to Equipment
13.1 During the hire period, the Hirer is responsible for taking reasonable care of the Equipment.
13.2 The Hirer must notify SB Lite as soon as reasonably possible of any loss, theft or significant damage.
13.3 The Hirer must not carry out or attempt repairs without SB Lite’s prior permission.
13.4 Where Equipment is damaged as a result of misuse, negligence or failure to take reasonable care, the Hirer may be charged the reasonable cost of repair.
13.5 Where Equipment, accessories, reusable packaging or other items supplied as part of the hire are lost, not returned or damaged beyond reasonable repair or reuse, the Hirer may be charged the applicable replacement cost.
13.6 Replacement costs are set out in the Replacement Cost List provided or made available as part of the booking. The Hirer agrees to these replacement costs when accepting the booking and these Terms.
13.7 Where an item is not included in the Replacement Cost List, the Hirer may be charged the reasonable cost of repairing or replacing it with an item of the same or equivalent specification.
13.8 The Hirer will not be responsible for reasonable wear and tear resulting from proper use.
14. Failure to Return Equipment
14.1 If Equipment is not returned by the required return date, SB Lite may contact the Hirer and take reasonable steps to recover its property.
14.2 Until the Equipment is handed to and accepted by an authorised return service, the Hirer remains responsible for its reasonable safekeeping and may be liable for applicable late return charges.
14.3 If Equipment is not returned and SB Lite reasonably considers it lost, permanently unreturned or beyond reasonable recovery, the Hirer may be charged the applicable replacement cost.
14.4 SB Lite may take reasonable steps to recover Equipment and/or amounts properly due under these Terms, including using a debt recovery service, instructing solicitors or commencing legal proceedings where appropriate.
14.5 SB Lite may report Equipment as missing or unlawfully retained to the police or another appropriate authority where SB Lite reasonably believes the circumstances warrant doing so.
15. Insurance
15.1 Unless expressly agreed otherwise, SB Lite does not provide insurance covering the Hirer’s possession or use of the Equipment.
15.2 The Hirer is responsible for arranging any insurance reasonably required for their intended use, including public liability insurance where appropriate.
16. Hire Charges and Payment
16.1 Hire Charges are payable in full when the booking is made unless SB Lite expressly agrees otherwise.
16.2 SB Lite is not required to dispatch or release Equipment until all amounts required before the hire have been paid and all other pre-hire requirements have been satisfied.
17. Security Deposit
17.1 All hires are subject to a security deposit.
17.2 Unless otherwise stated on the Hire Confirmation, the security deposit is £75 for each set of up to 10 uplighters, subject to a minimum security deposit of £75.
- 1–10 uplighters: £75
- 11–20 uplighters: £150
- 21–30 uplighters: £225
The applicable security deposit will be displayed or confirmed as part of the booking.
17.3 The security deposit must be successfully paid or pre-authorised no later than 5:00pm on the day before the Equipment is due to be delivered to or collected by the Hirer, unless otherwise agreed by SB Lite in writing.
17.4 Successful payment or pre-authorisation of the security deposit is a condition of SB Lite releasing the Equipment.
If the security deposit has not been successfully paid or authorised by the deadline, SB Lite may suspend or cancel the hire and is under no obligation to release or deliver the Equipment.
17.5 Where Equipment has already been dispatched and the security deposit is not subsequently successfully paid or authorised by the deadline, SB Lite may instruct the courier to return the Equipment to SB Lite before delivery.
17.6 Failure to provide the required security deposit by the deadline may be treated as a cancellation or default by the Hirer. SB Lite may cancel the hire and the Hire Charges will remain non-refundable, subject to applicable law.
18. Security Deposit Authorisation
18.1 Security deposits are normally processed by placing a temporary authorisation (“pre-authorisation”) on the Hirer’s payment card through SB Lite’s payment service provider.
A pre-authorisation reserves the relevant amount against the available balance or credit limit but does not normally result in the funds being taken by SB Lite at that time.
18.2 Card authorisations are available for a limited period determined by the card issuer, card network and payment service provider. Where the Equipment has not been returned and satisfactorily inspected before the authorisation is due to expire, SB Lite may capture the security deposit so that it can continue to be held until the Equipment has been returned and inspected.
18.3 Capturing the security deposit does not mean it has been forfeited. Once the Equipment has been returned and inspected, any amount not properly required by SB Lite under these Terms will be refunded.
18.4 SB Lite will normally inspect returned Equipment within 3 working days of receiving it.
Following satisfactory inspection, SB Lite will release the security deposit pre-authorisation or, where it has been captured, arrange for the appropriate amount to be refunded.
The time subsequently taken for a released authorisation or refund to appear on the Hirer’s account is outside SB Lite’s control and may depend upon the Hirer’s bank or card provider.
18.5 SB Lite may retain or deduct amounts properly due under these Terms from the security deposit, including reasonable amounts relating to:
- lost or unreturned Equipment;
- damage to Equipment;
- late return charges;
- reasonable additional cleaning;
- missing accessories, cables, remotes, cases or other supplied items;
- reusable boxes, cases, custom foam inserts or protective packaging which are missing or damaged beyond reasonable reuse; and
- other amounts properly due as a result of the Hirer’s use, loss, damage or late return of the Equipment.
18.6 Where a deduction is made, SB Lite will provide details of the amount deducted and the reason.
18.7 Where reasonably practicable, SB Lite will notify the Hirer if it becomes necessary to capture a previously pre-authorised deposit because the authorisation is due to expire.
18.8 Payment card details are processed securely by SB Lite’s payment service provider. SB Lite does not store the Hirer’s payment card details.
18.9 The security deposit does not limit the Hirer’s liability. Where an amount properly due exceeds the deposit, the Hirer remains liable for the outstanding balance.
19. Cancellation by the Hirer
19.1 A confirmed booking reserves Equipment for a specific period and may result in SB Lite refusing other bookings for the same Equipment or dates.
19.2 Once a booking has been confirmed, Hire Charges are non-refundable if the Hirer subsequently chooses to cancel, subject always to statutory cancellation or refund rights which apply.
19.3 The Hirer should notify SB Lite as soon as reasonably possible if they no longer require their booking.
19.4 Failure to comply with a requirement of the booking, including:
- failure to provide the required security deposit;
- failure to provide required identification;
- failure to provide information reasonably required to fulfil the booking;
- refusal or failure to accept delivery; or
- failure to attend an agreed collection,
may be treated as cancellation or default by the Hirer.
SB Lite may cancel the hire in these circumstances and Hire Charges will remain non-refundable, subject to applicable law.
19.5 Where Equipment has already been prepared, packed or dispatched when the Hirer cancels or defaults, the Hirer may also be responsible for reasonable additional costs directly incurred as a result, where permitted by law.
19.6 Nothing in these Terms excludes or limits statutory cancellation or refund rights which cannot lawfully be excluded.
20. Cancellation by SB Lite
20.1 SB Lite may suspend or cancel a hire where:
- required payments or the security deposit have not been provided;
- required identity verification has not been satisfactorily completed;
- SB Lite reasonably believes the Equipment is at material risk of loss, damage, misuse or unlawful use;
- materially incorrect or misleading information has been supplied; or
- the Hirer has materially breached these Terms.
20.2 Where cancellation results from the Hirer’s failure to comply with the Contract, Hire Charges will remain non-refundable, subject to applicable law.
20.3 Where SB Lite cancels a booking for reasons which are not attributable to the Hirer and cannot provide the booked Equipment or a reasonable alternative, SB Lite will refund the Hire Charges paid for the affected hire.
21. Delivery
21.1 Equipment will normally be delivered using DPD or another courier appointed by SB Lite.
21.2 Delivery dates and times are estimates and are not guaranteed.
SB Lite will take reasonable steps to dispatch Equipment in sufficient time for the agreed hire, but courier services can experience delays or failed deliveries outside SB Lite’s direct control.
21.3 The Hirer is responsible for providing a complete and accurate delivery address, contact details and other information reasonably required for delivery.
21.4 The Hirer is responsible for ensuring that delivery can reasonably be completed, including ensuring somebody is available where attendance is required.
21.5 Delivery may be made to a residential address, business, venue, hotel or another address accepted by SB Lite.
Where delivery is made to a venue, hotel, business or similar address, delivery to reception, concierge, goods-in, an employee or another person reasonably accepting deliveries at that address will normally constitute successful delivery.
22. Safe-Place and Altered Deliveries
22.1 Where the Hirer requests or authorises DPD or another courier to leave Equipment in a safe place, with a neighbour, at a collection point or using another unattended delivery option, this is done at the Hirer’s risk.
22.2 Once the courier records Equipment as successfully delivered in accordance with the Hirer’s instructions, including any available photograph, scan or delivery confirmation, SB Lite will not normally be responsible for subsequent loss, theft, damage or the Hirer’s inability to locate the Equipment, subject to applicable law.
22.3 Changes made by the Hirer directly with the courier to the delivery address, date, safe place, neighbour, collection point or other delivery arrangements are at the Hirer’s risk. A delay or failed delivery resulting from such a change will not normally entitle the Hirer to a refund.
23. Failed or Delayed Delivery
23.1 Where Equipment is not delivered in time for the event solely because of a failure by DPD or another courier appointed by SB Lite, and SB Lite determines that the Hirer did not cause or materially contribute to the failure, SB Lite will refund the Hire Charges paid for the affected hire.
23.2 SB Lite will determine the cause of a failed or delayed delivery acting reasonably and having regard to available information, including tracking, delivery scans, photographs, location information, attempted-delivery records and relevant communications.
23.3 A refund will not normally be provided where delivery is unsuccessful or delayed because of an act or omission of the Hirer or somebody acting on their behalf, including:
- nobody being available where attendance is required;
- an incorrect, incomplete or inaccessible address;
- refusal of delivery;
- failure to respond to reasonable delivery instructions;
- unavailable or restricted access;
- changes made by the Hirer to delivery arrangements;
- safe-place, neighbour or collection-point instructions which result in the Equipment not being available when required; or
- another act or omission which prevents or materially contributes to successful delivery.
23.4 Where a delivery attempt has been made in accordance with information supplied by the Hirer but cannot be completed for a reason attributable to the Hirer, Hire Charges will remain non-refundable, subject to applicable law.
23.5 Where reasonably possible, SB Lite may assist with a delayed or failed delivery by contacting the courier, arranging redelivery or providing alternative Equipment.
SB Lite does not guarantee that this will be possible before the Hirer’s event.
23.6 The Hirer should notify SB Lite as soon as reasonably possible if tracking indicates a problem or Equipment has not arrived when reasonably expected, giving SB Lite a reasonable opportunity to investigate and resolve the problem.
24. Liability for Delivery Delays
24.1 Where SB Lite determines that Equipment was not delivered in time solely because of a failure by its appointed courier, SB Lite will refund the Hire Charges paid for the affected hire.
24.2 To the fullest extent permitted by law, SB Lite will not be liable for indirect, consequential or additional loss, cost, expense or charge resulting from a delayed, failed or missed delivery.
This includes, without limitation:
- replacement or alternative equipment obtained elsewhere;
- venue or supplier charges;
- contractor or staffing costs;
- travel expenses;
- loss of revenue or profit;
- loss of business;
- loss of opportunity;
- loss of enjoyment; or
- other costs or losses associated with the Hirer’s event or intended use of the Equipment.
24.3 Where a refund is due because of courier failure, SB Lite’s liability in respect of the affected hire will, to the fullest extent permitted by law, be limited to the Hire Charges paid to SB Lite for that affected hire.
24.4 Nothing in these Terms excludes or limits liability which cannot lawfully be excluded or limited.
25. Early Delivery
25.1 SB Lite may dispatch Equipment before the booked hire date to provide additional time for delivery.
25.2 Where Equipment arrives earlier than required as a result of SB Lite’s normal dispatch arrangements, no additional Hire Charge will be payable solely because of the early delivery.
25.3 The Hirer may request an earlier planned delivery date where this service is offered by SB Lite. Additional charges may apply and will be shown or agreed before the service is confirmed.
25.4 Early delivery does not alter the required return date unless expressly agreed by SB Lite.
26. Return of Equipment
26.1 Unless a collection service has been purchased or otherwise agreed by SB Lite, the Hirer must return the Equipment using the DPD return service specified or provided by SB Lite.
26.2 The Hirer is responsible for ensuring that all Equipment, accessories and reusable packaging are correctly and securely packed in accordance with the return instructions supplied by SB Lite.
All boxes must be securely closed and adequately taped to prevent them from opening during transit. Where SB Lite supplies or specifies a return label, the correct label must be securely attached to the appropriate parcel before it is handed to DPD.
Any old, incorrect or conflicting courier labels and barcodes must be removed or completely covered where reasonably necessary to ensure that the parcel is correctly identified and routed.
26.3 The Hirer must hand the correctly packed, secured and labelled Equipment to an authorised DPD drop-off location no later than the return date specified by SB Lite.
26.4 Equipment will be treated as returned on time where it has been accepted and scanned by an authorised DPD drop-off location on or before the required return date.
26.5 The Hirer must obtain and retain the DPD receipt or other proof of acceptance until SB Lite confirms that the Equipment has been received. Where requested, the Hirer must provide this proof to SB Lite.
26.6 Provided that the Equipment has been correctly packed, securely closed, adequately taped and correctly labelled in accordance with SB Lite’s return instructions, and has been accepted by DPD using the return service supplied or authorised by SB Lite, the Hirer will not normally be responsible for subsequent delay, loss or damage occurring solely while the Equipment is in DPD’s possession.
26.7 Where Equipment is inadequately packed, not securely closed, incorrectly labelled, or returned using a label or return service other than one supplied or authorised by SB Lite, the Hirer may be responsible for any resulting loss, damage, delay or reasonable additional courier costs.
26.8 Equipment left at a shop, premises, collection point or other location without being formally accepted or scanned by DPD will remain the Hirer’s responsibility until acceptance by DPD can be verified.
26.9 Where the Hirer chooses or arranges their own return service instead of the return service supplied or authorised by SB Lite, the Equipment remains the Hirer’s responsibility until it is received by SB Lite.
26.10 Where the Hirer fails to hand the Equipment to DPD by the required return date, applicable late return charges may apply in accordance with these Terms.
27. Paid Collection Service
27.1 Where the Hirer purchases a collection service, Equipment must be correctly packed and available at the agreed collection address on the agreed date.
27.2 Where collection fails because Equipment was unavailable, incorrectly packaged, incorrectly labelled, access could not be obtained or for another reason attributable to the Hirer, SB Lite may charge the reasonable cost of arranging another collection.
Applicable late return charges may also apply.
27.3 Where collection fails solely because of SB Lite or its appointed courier, the Hirer will not be charged a late return fee solely as a result of that failed collection, provided the Equipment was correctly packed and available as instructed.
28. Return Packaging
28.1 Reusable packaging supplied with the Equipment, including boxes, cases, custom foam inserts and other protective packaging, forms part of the hire and must be retained and returned.
28.2 The Hirer must take reasonable care of the packaging and must not dispose of, substantially alter or intentionally damage it.
28.3 Equipment must be securely repacked using the supplied packaging and reasonable return instructions.
28.4 The Hirer may be responsible for damage to Equipment caused by failure to reasonably follow the packing instructions.
28.5 Packaging which is lost, disposed of or damaged beyond reasonable reuse may be charged at the applicable amount shown in the Replacement Cost List.
28.6 Reasonable wear and tear resulting from proper use and normal transportation will not be charged.
29. Non-Mainland Delivery
29.1 Deliveries to non-mainland destinations, remote areas or other locations attracting additional courier costs may be subject to an additional delivery surcharge.
29.2 Any applicable surcharge will be displayed, quoted or agreed as part of the booking.
30. Additional Charges and Overdue Amounts
30.1 Any additional amount properly due under these Terms, including charges arising from loss, damage, missing items, late return or amounts exceeding the security deposit, must be paid by the deadline specified when the Hirer is notified.
30.2 Where an amount remains unpaid, SB Lite may take reasonable steps to recover it, including referring the debt to a debt recovery agency, instructing solicitors or commencing legal proceedings where appropriate.
30.3 Where permitted by law, SB Lite may seek reasonable costs necessarily incurred in recovering an overdue amount.
30.4 Where the Hirer is a Business Hirer, SB Lite reserves the right to claim interest, compensation and recovery costs available under applicable late-payment legislation.
30.5 Liability for amounts properly due is not limited to the security deposit.
31. Limitation of Liability
31.1 Nothing in these Terms excludes or limits SB Lite’s liability where it would be unlawful to do so.
31.2 Subject to clause 31.1 and to the fullest extent permitted by law, SB Lite will not be liable for indirect or consequential losses arising from the hire or use of Equipment.
31.3 SB Lite is not responsible for losses resulting from the Hirer’s:
- misuse of Equipment;
- failure to follow instructions;
- failure to notify SB Lite reasonably promptly of a problem;
- unauthorised charging, modification or repair of Equipment;
- inappropriate outdoor use;
- failure to obtain venue or other permissions; or
- use of Equipment for a purpose for which it was not reasonably intended.
31.4 Nothing in these Terms affects statutory rights which cannot lawfully be excluded or restricted.
32. Circumstances Outside Our Control
32.1 SB Lite will not be responsible for delay or failure to perform an obligation where this results from circumstances outside its reasonable control, subject to applicable law.
32.2 Where such circumstances affect a booking, SB Lite will take reasonable steps to minimise their effect and contact the Hirer where reasonably practicable.
33. Business Bookings
33.1 Where a booking is entered into by a limited company or other incorporated organisation, liability will ordinarily rest with that organisation unless a separate personal guarantee or other arrangement has expressly been agreed.
33.2 A person making a booking on behalf of a Business Hirer confirms that they have authority to enter into the Contract on its behalf.
34. Personal Information and Payment Processing
34.1 SB Lite may process personal information reasonably necessary to administer bookings, verify Hirers, deliver and recover Equipment, process payments, communicate with Hirers, prevent fraud and protect its legitimate business interests.
34.2 Payment card transactions are processed using SB Lite’s payment service provider. SB Lite does not store the Hirer’s full payment card details.
34.3 Further information about how personal information is processed may be provided in SB Lite’s Privacy Policy.
35. Communications
35.1 The Hirer is responsible for providing accurate email, telephone and other contact information.
35.2 SB Lite may use the contact details supplied with the booking to send communications reasonably connected with the hire, including booking confirmations, identification requests, security deposit requests, delivery information, return instructions and notices concerning the Equipment.
35.3 The Hirer should notify SB Lite promptly if their contact details change.
36. Amendments to a Booking
36.1 Any amendment to a confirmed booking is subject to availability and must be agreed by SB Lite. The Hirer has no automatic right to amend or transfer a confirmed booking.
36.2 A request to change the hire or event date will normally be treated as cancellation of the original booking and the creation of a new booking. The Hire Charges paid for the original booking will remain non-refundable in accordance with these Terms, and the applicable Hire Charges for the new date will be payable.
36.3 SB Lite may, at its discretion, agree to transfer a booking or some or all of the Hire Charges paid to an alternative date. Any such agreement is a goodwill arrangement and does not create an obligation for SB Lite to agree to date changes for any other booking.
36.4 Where SB Lite agrees to an amendment, additional charges may apply where the amendment changes the Equipment, quantity, delivery arrangements, return arrangements, hire duration or other services provided.
36.5 No amendment is confirmed until it has been accepted by SB Lite and any additional Hire Charges or other amounts required by SB Lite have been paid.
37. Marketing
37.1 SB Lite may photograph its Equipment while installed or in use for legitimate promotional purposes where appropriate.
37.2 SB Lite will take reasonable care not to publish identifiable photographs of individuals without an appropriate lawful basis or permission where required.
38. Governing Law
38.1 These Terms and the Contract are governed by the laws of England and Wales.
38.2 Nothing in this clause affects a Consumer Hirer’s statutory rights concerning where legal proceedings may be brought.
38.3 For Business Hirers, the courts of England and Wales will have exclusive jurisdiction unless otherwise agreed in writing.
39. General
39.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
39.2 A failure or delay by SB Lite in exercising a right under these Terms does not mean that SB Lite has waived that right.
39.3 These Terms, together with the Hire Confirmation, Replacement Cost List and any other terms expressly incorporated into the booking, form the Contract between SB Lite and the Hirer.
39.4 Nothing in these Terms affects any statutory rights of a Consumer Hirer which cannot lawfully be excluded or restricted.
